Terms of Use

These Terms of Use govern your use of the TreasureHop mobile application and website. By creating an account or using TreasureHop, you agree to be bound by these Terms. Please read them carefully.

TreasureHop is operated by Allison Burrows trading as TreasureHop (Queensland, Australia).

1. About TreasureHop

TreasureHop is a marketplace platform that connects people holding garage sales (Sellers) with people looking for garage sales (Buyers) in their local area. TreasureHop provides the platform only. We are not a party to any transaction between Buyers and Sellers, and we do not guarantee the quality, safety or legality of any items listed.

2. Eligibility

To use TreasureHop you must:

• Be at least 18 years of age
• Be a natural person (businesses and organisations may not register as users without our prior written consent)
• Not be prohibited from using the service under any applicable law

By using TreasureHop you represent and warrant that you meet these requirements. TreasureHop is not intended for use by persons under the age of 18. If we become aware that a user is under 18, we will suspend or terminate that account.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at hello@treasurehop.com.au if you suspect any unauthorised use of your account.

You must provide accurate and complete information when creating your account and keep it up to date. TreasureHop reserves the right to suspend or terminate accounts that contain false or misleading information.

4. Seller Obligations

As a Seller on TreasureHop you agree to:

• Only list genuine garage sales that you intend to hold
• Provide accurate and honest descriptions of items you are selling
• Set a legitimate sale address — this is the address that will be revealed to Buyers at your chosen reveal time
• Not list prohibited items (see Sections 6 and 7 below)
• Honour your listing — if you cancel a sale, cancel it promptly in the app so Buyers are notified
• Behave honestly and courteously toward Buyers

5. Buyer Obligations

As a Buyer on TreasureHop you agree to:

• Use the platform to find genuine garage sales only
• Respect Sellers' privacy — do not attempt to identify a Seller's address before the reveal time
• Behave honestly and courteously toward Sellers
• Not use information obtained through TreasureHop for any purpose other than attending garage sales
• Attend garage sales at your own risk and exercise reasonable personal safety precautions

6. Prohibited Conduct

You must not use TreasureHop to:

• List, offer or sell illegal items, including but not limited to: stolen goods, firearms, ammunition, weapons or weapon components, illegal drugs or drug paraphernalia, prescription medications, counterfeit or replica products, items regulated under Australian or state law, or any material that exploits, sexualises or harms minors
• Harass, threaten, stalk or abuse other users
• Post false, misleading or fraudulent listings
• Scrape, harvest or collect data from TreasureHop without our prior written consent
• Attempt to circumvent the address reveal feature or access another user's address before the reveal time
• Create multiple accounts to circumvent a suspension or ban
• Use the platform for ongoing commercial retail activity — TreasureHop is intended for genuine one-off private garage sales, not as a primary retail or commercial sales channel
• Violate any applicable law or regulation

7. Prohibited Items

In addition to Section 6, the following categories of items are expressly prohibited on TreasureHop:

• Firearms, firearm parts, ammunition and accessories
• Knives, tasers, capsicum spray and other regulated weapons (restrictions vary by Australian state — when in doubt, do not list it)
• Illegal drugs, drug paraphernalia and prescription-only medications
• Stolen property
• Counterfeit, fake or replica branded goods
• Items subject to recall or that pose a known safety risk
• Child exploitation material or any content that sexualises minors
• Any item whose sale is restricted or prohibited under Commonwealth or state law

This list is not exhaustive. TreasureHop reserves the right to remove any listing that we consider inappropriate, harmful or potentially unlawful, even if not specifically listed here.

8. Reporting Prohibited Content

If you see a listing that you believe violates these Terms or is unlawful, use the "Report Listing" button available on every listing page. Your report will be logged and reviewed by our team within 5 business days.

TreasureHop reserves the right to remove any listing, without notice, that we reasonably believe violates these Terms or any applicable law. We may also refer information to law enforcement authorities where appropriate.

Submitting a false or malicious report is a breach of these Terms and may result in account suspension.

9. The Q&A Feature

TreasureHop includes a public Q&A feature that allows Buyers to ask Sellers questions about their listing. This feature is controlled by the Seller and is off by default. When enabled, questions and answers are visible to all users.

You are responsible for the content you post. You must not post content that is defamatory, abusive, misleading, illegal or in breach of any third-party rights. TreasureHop reserves the right to remove any Q&A content that violates these Terms, without notice. If you believe Q&A content is inappropriate, use the Report function or contact us at hello@treasurehop.com.au and we will review within 5 business days.

10. Intellectual Property

All content, features and functionality of TreasureHop, including the name, logo, design, text, graphics and code, are owned by TreasureHop and are protected by Australian and international intellectual property laws.

By submitting photos and content to TreasureHop, you grant us a non-exclusive, royalty-free licence to use, display and distribute that content in connection with operating and promoting the platform. You represent that you own or have the right to submit any content you post.

11. Your Indemnification Obligations

You agree to indemnify, defend and hold harmless TreasureHop and its operators from and against any claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising from:

• Your use of TreasureHop
• Your breach of these Terms
• Any listing you post, including any claim that your listing or the items listed are unlawful or infringe a third party's rights
• Any transaction you enter into with another user
• Any injury, damage or loss suffered by a Buyer attending a sale you listed

12. Limitation of Liability

Nothing in these Terms excludes, restricts or modifies any rights you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that cannot be excluded, restricted or modified by agreement.

Subject to the above, and to the maximum extent permitted by Australian law, TreasureHop and its operators will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the platform, including but not limited to:

• Any transaction between a Buyer and Seller
• The quality, safety or condition of any items sold
• Any loss or damage arising from attending a garage sale found through TreasureHop
• Any technical failure, downtime or data loss
• Any unintended disclosure of a sale address due to user error or technical failure

13. Disclaimers

TreasureHop is provided "as is" without warranties of any kind, either express or implied, to the extent permitted by law. We do not warrant that the platform will be uninterrupted, error-free or free of viruses or other harmful components.

TreasureHop does not verify the identity of users or the accuracy of listing information. You interact with other users at your own risk. We strongly encourage you to take reasonable personal safety precautions when attending any garage sale, including telling someone where you are going.

14. Privacy

Your privacy is important to us. Our Privacy Policy explains what personal information we collect, how we use it, and how we protect it. By using TreasureHop, you agree to the collection and use of your information in accordance with our Privacy Policy.

15. Termination

TreasureHop reserves the right to suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or if your conduct is harmful to other users or the platform.

You may request deletion of your account and associated data at any time by contacting us at hello@treasurehop.com.au or via the account deletion page on our website. We will process your request within 30 days. Please note that some data may be retained after deletion where required by law or for legitimate business purposes including fraud prevention, dispute resolution and legal compliance.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or a notice in the app at least 14 days before the changes take effect. Your continued use of TreasureHop after changes take effect constitutes your acceptance of the updated Terms. The "Last updated" date at the top of this page reflects the most recent revision.

17. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of Queensland. We encourage you to contact us first to resolve any dispute before initiating formal legal proceedings.
